Student accommodation regulation in Ireland (2026)
Ireland does have a figure for student residences: student specific accommodation, which since 2019 sits within tenancy law and under the Residential Tenancies Board, whether it is signed as a tenancy or as a licence. Since 2024 the contract cannot run beyond 41 weeks unless the student asks, and since March 2026 rent has a national cap. Data follows the GDPR and the Data Protection Act 2018, with the Data Protection Commission.
The short answer
Ireland has a figure of its own, student specific accommodation (SSA), and a body that registers it and resolves disputes: the Residential Tenancies Board (RTB).
| What | Rule | Who applies it |
|---|---|---|
| Legal figure | Residential Tenancies (Amendment) Act 2019, s. 3 | The RTB |
| Contract | 2019 Act, s. 37, and Residential Tenancies (Amendment) Act 2024 | The RTB, including in disputes |
| Rent | Residential Tenancies (Miscellaneous Provisions) Act 2026 | The RTB |
| Building and fire safety | Fire Services Act 1981, s. 18 and Building Control Act 1990, s. 6 | The fire authority and the building control authority |
| Data | GDPR and Data Protection Act 2018 | The Data Protection Commission |
| AI | Regulation (EU) 2024/1689, Art. 50, and Regulation of Artificial Intelligence Act 2026 | The authorities Ireland designates |
What student specific accommodation is
Since 2019, tenancy law reaches a dwelling in a building, or part of one, used solely to house students during academic term, even if it has other uses outside term (Residential Tenancies (Amendment) Act 2019, s. 3, which inserts s. 3(1A) into the 2004 Act). This is what the RTB calls SSA, whether a university, a college or a private company runs it.
It has two boundaries: it is not SSA if the landlord is an individual who lives in the same building ("digs"), nor is an ordinary flat let to a student, which is a standard private tenancy. SSA status is declared when the tenancy is registered with the RTB.
Lease or licence: the same regime
Calling the contract a licence does not take it outside the law: s. 37 of the 2019 Act applies the Residential Tenancies Act 2004 to student accommodation licences as to tenancies. What does not apply to SSA is Part 4, on security of tenure (s. 3(7)).
The Residential Tenancies (Amendment) Act 2024 added three rules: the contract cannot exceed 41 weeks unless the student asks for more (s. 19C); no more than one month's rent can be taken in advance unless the student pays rent and tuition fees to the same provider; and the student can end the tenancy between 1 May and 1 October. Nor can the deposit exceed one month, according to the RTB.
Since 1 March 2026, national rent control reaches SSA: the yearly increase is at most 2% or inflation measured by the CPI, whichever is lower, and resetting to market rent is only allowed every three years, the first time from 1 March 2029. New SSA whose works were notified from 10 June 2025 can rise with the CPI even above 2% (RTB; 2026 Act, s. 8). Each room is registered with the RTB as a separate tenancy, at the start and every year (RTB).
The building: fire safety and minimum standards
Whoever controls a building with sleeping accommodation, other than a single dwelling house, must take all reasonable measures against fire (Fire Services Act 1981, s. 18). And building control law allows a fire safety certificate to be required before construction, for the classes of building set by regulations (Building Control Act 1990, s. 6(2)(a)(ii)).
Every rented dwelling must meet minimum standards of condition, facilities and safety (Housing (Standards for Rented Houses) Regulations 2019), whose exceptions (art. 3) do not include student accommodation, and the local authority can inspect it, according to the RTB.
GDPR, the Data Protection Act 2018 and AI
The GDPR applies, supplemented by Ireland's Data Protection Act 2018, and the Data Protection Commission supervises. For a residence that answers on WhatsApp, the same as anywhere else in the Union: a lawful basis (Art. 6), information for the resident (Art. 13) and a contract with the provider that processes the data (Art. 28). The age of a child's consent for information society services is 16 (s. 31).
With the database in the Union there is no international transfer; if a provider processes data in the US, Art. 46 safeguards are needed, such as standard contractual clauses.
Art. 50 of Regulation (EU) 2024/1689 has applied since 2 August 2026: anyone talking to an assistant must know it is an AI, unless that is obvious. The Regulation of Artificial Intelligence Act 2026, of 21 July 2026, sets up Oifig IS na hÉireann, the national AI office, and comes into force by ministerial order. And employers with fifty or more employees must have internal reporting channels (s. 6 of the 2014 Act, as amended by the Protected Disclosures (Amendment) Act 2022).
What the rules do not say
Worth knowing
That a flat let to students is SSA. It is not for that reason, and then the 41-week limit does not apply. That a provider can offer only 51-week contracts. It cannot request or require them: a longer one is only possible if the student asks and the landlord agrees (s. 19C(3)). That SSA has the security of a private tenancy. Part 4 does not apply to it (s. 3(7)), and ending it follows its own rules.
Nor does the 2026 AI Act set when its office starts work: ministerial orders decide that, and Art. 50 of the Regulation applies regardless.
Where Bedel fits
Bedel handles the residence's WhatsApp in the language the person writes in and passes to a team member whatever a machine should not settle, such as a question about the contract. Its data lives in the European Union, in Ireland, and the AI model runs in the US under standard contractual clauses. What changes in the contract and the processing for an Irish centre is discussed before signing.
Frequently asked questions
Is a student licence outside the Residential Tenancies Act?
No. Section 37 of the Residential Tenancies (Amendment) Act 2019 applies the 2004 Act to student accommodation licences as it applies to tenancies: the licensor counts as landlord and the licensee as tenant. That is why the provider registers each room with the Residential Tenancies Board and the student can use its dispute resolution service.
How long can a student accommodation contract last?
Forty-one weeks at most, under section 19C, which the Residential Tenancies (Amendment) Act 2024 inserted into the 2004 Act. The provider cannot request or require a longer contract; a longer one is only possible if the student asks for it and the landlord agrees. The rule applies to student specific accommodation, not to a private flat let to a student.
How much can be charged in advance?
As a rule, one month's rent in advance and a deposit of no more than one month, according to the Residential Tenancies Board: in total, no more than the equivalent of two months to secure the place. The 2024 Act only allows more than one month's rent in advance when the student pays rent and tuition fees to the same provider and the landlord agrees.
How much can student accommodation rent rise in 2026?
Since 1 March 2026, at most 2% a year or inflation measured by the CPI, whichever is lower. Resetting to market rent is only allowed every three years, the first time from 1 March 2029. New buildings whose works were notified from 10 June 2025 can rise with the CPI even above 2%, according to the Residential Tenancies Board.
Which data protection law applies to a residence in Ireland?
The GDPR, as across the Union, supplemented by Ireland's Data Protection Act 2018, with the Data Protection Commission as the authority. If the database is in the Union there is no international transfer; if a provider processes data in the US, safeguards such as standard contractual clauses are needed. And since 2 August 2026, the AI assistant must say that it is one, unless that is obvious.
