Student accommodation regulation in Italy (2026)
Italy defines the student residence in law. Legislative Decree 68/2012 creates the struttura residenziale universitaria (university residential facility), splits it into collegi and residenze and says that, in private ones, the resident signs a hotel-type hospitality contract, not a tenancy. The collegi universitari di merito also need recognition from the Ministry. A flat let to students is something else: Law 431/1998. Here are the articles on Normattiva, data protection, the Italian AI law and what they leave out.
The short answer

|---|---|---|
| Type of accommodation | Legislative Decree 68/2012, Arts. 13 to 17 | The operator; the Ministry recognises collegi (Art. 16) |
| Contract with the resident | Legislative Decree 68/2012, Art. 13(5); Law 431/1998, Art. 5 | Operator and resident; local agreements of the municipality (Art. 5(3)) |
| Fire safety | Presidential Decree 151/2011, Annex I, activity 66 | Whoever runs a studentato with more than 25 beds |
| Data protection | GDPR and the Privacy Code | The Garante |
| AI | Law 132/2025 and Regulation (EU) 2024/1689, Art. 50 | AgID and ACN (Art. 20 of Law 132/2025) |
| Whistleblowing channel | Legislative Decree 24/2023, Arts. 2 and 4 | Private entities with an average of 50 or more workers |
What they are called and how they differ
("An accommodation facility qualifies as a university residential facility if it has adequate space and services and can guarantee students the conditions to stay at the university seat so that they can attend their courses.")
- Collegio universitario (Art. 13(4)(a)): multipurpose spaces, hotel services and educational, cultural and recreational functions.
- Residenza universitaria (Art. 13(4)(b)): residential functions, "anche con servizi alberghieri" (also with hotel services), organised to make room for both private and social life.
- Collegio universitario di merito (Arts. 15 and 16): run by a non-profit body, it offers a personalised educational project and needs recognition from the Ministry. Like the Spanish colegio mayor (a hall of residence with a formative programme), it combines accommodation and education.
Most of the year's days of occupancy must go to university students; the rest may go to doctoral students, researchers, lecturers and, in summer, other guests (Art. 14).
Public residences rest on Law 338/2000: the State co-finances works by regions, right-to-study bodies, universities and collegi (Art. 1), and Art. 1-bis opens the funds of reform 1.7 of the National Recovery and Resilience Plan (PNRR) to private operators that provide new beds.
The contract with the resident
("In private university residential facilities, the relationship between the operator and the user is governed by a hotel-type hospitality contract, in writing and on the terms set by the decree in paragraph 7.")
In a private residence, then, there is no tenancy but written hotel-type hospitality. The rule does not apply to facilities of legally recognised non-state universities.
A flat let to students comes under Law 431/1998. Its Art. 5(2) allows contracts for the housing needs of university students on the contract types of Art. 4-bis, approved by a national agreement; Art. 5(3) lets municipalities with a university promote local agreements on rents. Without written form, the contract is not valid (Art. 1(4)). The current wording of Art. 5 has applied since 29 January 2002.
The building: fire safety, standards and change of use
Presidential Decree 151/2011 lists in Annex I, activity 66, studentati with more than 25 beds, alongside hotels, hostels and dormitories: activities subject to fire prevention procedures.
For funded residences, a ministerial decree sets minimum quality standards that prevail over building regulations, without removing regional controls (Law 338/2000, Art. 1(4)). And within PNRR reform 1.7, a change of use to university residence is always allowed, even against the local plan, with a SCIA (certified notice of start of activity), complying with safety and hygiene, and with a use restriction of at least twelve years (Art. 1-quater).
Data protection, AI and WhatsApp
The GDPR applies together with the Privacy Code, adapted to the Regulation by Legislative Decree 101/2018 from 19 September 2018. The authority is the Garante (Art. 2-bis). On WhatsApp, the residence owes the Art. 13 GDPR information at first contact, a processing agreement with every provider (Art. 28) and an Art. 46 safeguard for anything leaving the European Economic Area, such as the standard contractual clauses.
Italy also has an AI law of its own, Law 132/2025, which applies in line with the European Regulation (Art. 1(2)). Its Art. 4 requires the processing of data linked to an AI system to be explained in clear, simple language (paragraph 3) and requires parental consent for a child under fourteen to use it (paragraph 4). The national AI authorities are AgID and ACN (Art. 20). Fourteen is also the Privacy Code's age (Art. 2-quinquies).
What the rules do not say
Worth knowing
Legislative Decree 68/2012 leaves to a ministerial decree (Art. 13(7)) the technical features and the terms of the hospitality contract: the law does not say how long it lasts, which hotel services it includes or what is charged. And calling a building a "collegio" does not make it a collegio universitario di merito: that takes non-profit management (Art. 15) and recognition by the Ministry (Art. 16).
Law 431/1998 does not set the length of the student contract either (it refers it to the Art. 4-bis types), and the SCIA change of use in Art. 1-quater of Law 338/2000 only applies within PNRR reform 1.7.
What Bedel does
Bedel runs the residence's WhatsApp: it answers in each resident's language, Italian included, and passes whatever a machine should not decide to a person's phone (handing over to people). The data lives in the European Union, in Ireland; the AI model runs in the United States under the Standard Contractual Clauses. Whatever Italian law changes in the contract and the processing is discussed before signing.
Frequently asked questions
What contract does a resident sign in a private university residence in Italy?
A hotel-type hospitality contract, in writing. Article 13(5) of Legislative Decree 68/2012 says so for private university residential facilities, and leaves the terms to a ministerial decree. It does not apply to facilities of legally recognised non-state universities. Letting a flat to students is different: it comes under Article 5 of Law 431/1998.
Can I call my residence a collegio?
It can be called that, but the name does not make it a collegio universitario di merito. For that, the managing body must not pursue profit, must offer a personalised educational project and must obtain recognition from the Ministry, which decides within one hundred and twenty days (Articles 15 and 16 of Legislative Decree 68/2012). Accreditation comes later, after five years at the earliest.
Does a student residence need fire safety approval?
If it has more than twenty-five beds, yes. Annex I of Presidential Decree 151/2011, activity 66, includes studentati with more than twenty-five places, alongside hotels, hostels and dormitories, among the activities subject to fire prevention procedures. Below that threshold, that activity does not include it.
What does the Italian AI law add for a WhatsApp assistant?
Law 132/2025, in force since 10 October 2025, requires information on data processing linked to AI to be given in clear, simple language, and requires parental consent for a child under fourteen to use these systems. From 2 August 2026, the European Regulation also requires telling people they are talking to an AI.
Does a residence need a whistleblowing channel in Italy?
If it employed an average of 50 or more workers over the last year, yes: Legislative Decree 24/2023 counts it among the private-sector bodies that must set up internal reporting channels that protect the identity of the person reporting. Those with no more than 249 workers may share the channel and its management (Article 4(4)).
Other countries
- United KingdomFour systems in one country: in England, membership of an approved management code weighs on whether a student building is an HMO and on which contract is signed; data follows UK GDPR.
- IrelandA figure of its own: student specific accommodation, within tenancy law and under the RTB since 2019, whether signed as a lease or as a licence.
- PortugalRules of its own for the building since January 2022 (Decree-Law 14/2022 and Ordinance 35-A/2022); the contract is a Civil Code tenancy and data goes through the GDPR and Law 58/2019.
- FranceThe résidence universitaire has a legal definition (Art. L631-12 of the Code de la construction et de l'habitation); the rest of student accommodation is let under the 1989 Act, as a furnished let or a bail mobilité.
- GermanyNo residence act: section 549(3) of the BGB cuts back tenant protection in a Studenten- oder Jugendwohnheim, and building rules and the data authority depend on each Land.
- NetherlandsNo residence act: Book 7 of the Civil Code gives student lettings the campus contract and the fixed-term contract, and the Bbl sets its own measurements for student housing.
- BelgiumThree student tenancy regimes, one per region, with different terms, deposits and exits; data protection and whistleblowing, by contrast, are federal.
- SpainThe starting point in Spain: which rule governs the legal figure, the contract, the building, the data and the AI of a student residence, with the guide for each.
